Purpose and Foundation

Discipline within La Asociación Ñeta is an extension of its principles. It exists to preserve order, respect, accountability, and the protection of all members and the community.

All disciplinary matters shall be handled in alignment with the Asociación’s core principles, particularly those related to respect, non-abuse, and the protection of the humble and vulnerable.

The Disciplinary Committee is the body responsible for administering discipline, reviewing violations, and issuing sanctions. However, formal sentencing structures shall be fully developed upon the establishment of comprehensive rules. In the interim, discipline shall be guided by foundational norms derived directly from the Asociación’s principles.

Foundational Norms

Until formal rules are codified, the following norms shall serve as binding standards of conduct:

Article 1. Protection Against Exploitation

Members shall not steal from one another or from individuals who are economically vulnerable or struggling to survive.

Article 2. Prohibition of Indiscriminate Violence

Members shall not engage in acts of indiscriminate violence. Any use of force must be justified under clear and defensible circumstances consistent with the Asociación’s principles.

Article 3. Protection of Minors

Members shall not involve children in any criminal activity, including but not limited to the use, distribution, or sale of drugs.

Article 4. Protection of Vulnerable Persons

Members shall not harm, abuse, or exploit women, children, or senior citizens under any circumstances, regardless of personal relationships.

Article 5. Respect in Personal Relationships

Members shall not engage in relationships with another person’s partner unless it is clearly established that the relationship has been fully and permanently dissolved. This standard applies regardless of whether the individuals involved are members of the Asociación.

Article 6. Prohibition of Internal Conspiracy

Members shall not conspire against leadership or against any member. Concerns, disagreements, or grievances must be expressed through the proper channels established by the Asociación.

Article 7. Prohibition of Gossip and False Accusations

Members shall not spread gossip, rumors, or accusations without proof. All claims must be supported by evidence and submitted through official channels.

Article 8. Respectful Conduct

Members shall not engage in verbal abuse, including but not limited to insults, derogatory language, or defamatory labels against other members or individuals.

Article 9. Financial Integrity Among Members

Members shall act in good faith in all financial dealings. Borrowing between members must be conducted with honesty and responsibility.

The Asociación may provide financial assistance to members without interest, provided there is no evidence of abuse or exploitation of such support.

Article 10. Participation and Attendance

Members are required to attend meetings unless they present a valid and verifiable excuse. Participation is essential to ensure informed decision-making within the Asociación.

Article 11. Voluntary Membership and Separation

Membership in the Asociación is voluntary. Any member may leave at any time; however, those who voluntarily leave shall not be permitted to rejoin.

Members who are expelled shall be designated as persona non grata and shall not be readmitted.

Article 12. Complicity in Violations

Any member who conceals, supports, or covers up the violations of another member shall receive sanctions equal to double those imposed on the primary violator.

Article 13. Repeated Violations

Any member who accumulates three (3) violations shall be deemed inconsistent with the principles of the Asociación and shall be subject to expulsion.

Disciplinary Committee Structure

The Disciplinary Committee shall consist of:

  • The First (Chair)
  • The Second (Vice Chair)
  • The Advisor (Asesor)
  • The Secretary
  • The Moderator
  • Three Vocals (Vocales)
Roles and Responsibilities
Article 1. The First (Chair)

Leads the committee, oversees proceedings, ensures order, and represents the committee in official matters.

Article 2. The Second (Vice Chair)

Assists the First and assumes responsibilities in their absence.

Article 3. The Advisor (Asesor)

Provides guidance to ensure that all decisions align with the Asociación’s principles, norms, and constitutional framework.

Article 4. The Secretary

Receives all formal complaints, records proceedings, maintains documentation, and coordinates scheduling of hearings.

Article 5. The Moderator

Maintains order during proceedings. Ensures that all participants conduct themselves respectfully and without aggression. The Moderator does not impose physical punishment but is responsible for preventing escalation and maintaining a controlled environment.

Article 6. The Vocals (Vocales)

The Vocals serve as deliberative members of the committee.

Their responsibilities include:

  • Reviewing all evidence and submissions
  • Participating actively in discussions and debates
  • Representing balanced and reasoned perspectives
  • Voting on determinations of responsibility and outcomes

The Vocals act as essential voices of judgment and help ensure that decisions are not concentrated in a single authority but are the result of collective reasoning.

Complaint Process
Article 1. Submission of Complaint

All complaints must be submitted through the official Asociación platform and must include:

  • Name of the complainant
  • Date of submission
  • Date and location of the alleged violation
  • Name of the accused
  • Description of the alleged violations (by name and/or number)
  • A detailed, step-by-step account of the incident
  • Names of individuals with direct knowledge of the incident
  • Any supporting evidence or sworn affidavits

False statements or misleading affidavits shall themselves constitute violations.

Article 2. Initial Review

The Secretary shall receive the complaint and present it to the Disciplinary Committee, which shall schedule a formal hearing.

Article 3. Notification

The complainant shall be notified of the hearing date and must present all supporting individuals and evidence at that time.

Hearing and Decision

During the hearing:

  • All parties shall be given the opportunity to present their account
  • Evidence and testimony shall be reviewed
  • The committee shall deliberate and reach a decision
  • The accused shall be either:
    • Found not responsible (absolved), or
    • Found responsible (guilty)
Sanctions and Appeals
Article 1. Timing of Sanctions

Sanctions shall not be issued on the same day as the determination of responsibility. A separate determination shall be made regarding appropriate disciplinary action.

Article 2. Acceptance or Appeal

The accused may:

  • Accept the decision and sanction, or
  • Appeal to the National (Central Committee) Disciplinary Committee
Article 3. Appeals and Increased Sanctions

If a member knowingly appeals a decision despite being responsible, and the national body upholds the original finding, the sanction shall be doubled.

Article 4. Nature of Sanctions

The Asociación does not recognize physical punishment or financial penalties as disciplinary measures.

Sanctions shall be constructive, corrective, and aligned with dignity, accountability, and the principles of the Asociación.

Authority of the Disciplinary Committee

The Disciplinary Committee has full authority to investigate, hear, and decide on violations of the Asociación’s norms and principles.

All disciplinary actions must be grounded in fairness, evidence, and base y fundamento.

Objective of Discipline

The purpose of discipline is not punishment for its own sake, but the preservation of order, integrity, and adherence to the principles that define La Asociación Ñeta.
